  • where the child is the subject of a child protection plan or a section 47 investigation;
  • where the situation is an emergency, i.e. there is an immediate risk of harm to the child;
  • where the situation is a matter of urgency; where the relationship involves domestic abuse;
  • where the child is the subject of a child protection plan or a section 47 investigation; where the situation is a matter of urgency; 

 

How much does it cost to participate in mediation?

If you have a low income or are receiving certain benefits, you may be eligible for financial assistance from the government in the form of legal aid to help cover the expenses of mediation. Because of the means test, in order to demonstrate that you are eligible to receive it, you will be required to produce documentation of your present financial situation.

If you are required to pay for the mediation process, you should inquire about the fees charged by your mediator as soon as you make initial contact with them. You should probably call up a few different local mediators to compare their rates, as these can differ from one another.
